Terms of Service

These Terms of Service (“Terms”) govern your use of the Fren iOS app and website at fren.day. Fren is developed by Andrii Yemelianenko (“I”, “me”, “my”). By using Fren, you agree to these Terms and the Privacy Policy.

Terms at a Glance

• Fren is for personal journaling and reflection. You can record short voice memos and receive AI-generated insights, tags, summaries, and feedback.
• You must be at least 13. If the law where you live requires a higher minimum age, that higher age applies.
• No account is required. Fren works without a user account.
• AI outputs can be wrong. They may be incomplete, unhelpful, or inaccurate, and they are not medical, mental health, legal, or financial advice.
• Fren is free during beta. Paid subscriptions or features may be introduced later.
• If you misuse the app, I may limit or stop access.

What Fren Does

Fren is a journaling app. You record short voice memos, which are transcribed and analyzed by AI to provide mood insights, tags, summaries, and personalized feedback. Your journal is primarily stored on your device.

Who Can Use Fren

You may use Fren only if:

• You are at least 13 years old
• You can legally agree to these Terms
• You use the app in compliance with applicable law

If you are using Fren on behalf of someone else or an organization, you confirm that you have permission to do so.

Using Fren

You may use Fren only for its intended purpose as a personal journaling and reflection tool. You are responsible for your device, your local data, and any settings you enable, including optional iCloud sync.

You agree not to:

• Use Fren in a way that breaks the law or infringes someone else’s rights
• Interfere with the app, its infrastructure, or other users’ access
• Reverse engineer, copy, scrape, or try to extract the source code except where the law clearly allows it
• Use Fren to create, submit, or process harmful, abusive, fraudulent, or deceptive material
• Rely on Fren where mistakes could lead to serious health, legal, financial, or safety consequences

AI Features and Limitations

Fren uses third-party AI services to transcribe recordings and generate insights, tags, summaries, and feedback. These features are meant to support reflection. They are not guaranteed to be accurate, complete, or useful in every case.

Fren is not a doctor, therapist, crisis service, lawyer, or financial advisor. The app does not provide medical, mental health, legal, or financial advice. If you need that kind of help, use a qualified professional or an appropriate emergency resource.

AI output may sometimes feel off, repetitive, or blunt. That is part of the nature of the technology. Use your own judgment.

Your Content

You keep ownership of the voice memos, transcripts, and journal content you create in Fren.

By using Fren, you authorize me and the service providers I use to process your audio, text, and related data only as needed to operate the app’s features, consistent with the Privacy Policy.

Beta Status and Availability

Fren may still be in beta. Features may change, be interrupted, or disappear without notice. I may add, remove, pause, or stop parts of the app at any time.

I do not guarantee that Fren will always be available, error-free, or compatible with every device, OS version, or region.

Paid Features and Subscriptions

Fren is currently free during beta. In the future, I may introduce paid features or subscriptions.

If that happens, I will provide pricing, billing terms, and any product-specific rules before you are charged. Continued use of paid features may require you to agree to updated terms.

Intellectual Property

Fren, including the app, website, branding, design, and underlying software, is owned by me or my licensors and is protected by applicable intellectual property laws.

These Terms give you a limited, non-exclusive, non-transferable, revocable right to use Fren for personal, non-commercial use, subject to these Terms.

Privacy

Your use of Fren is also governed by the Privacy Policy, which explains how data is handled.

Suspension and Termination

You can stop using Fren at any time.

I may suspend or end your access to Fren if:

• You violate these Terms
• I need to protect the app, infrastructure, or other people
• I decide to discontinue the app or a feature

Termination does not affect any rights or obligations that, by their nature, should continue after access ends.

Disclaimers

To the fullest extent permitted by law, Fren is provided “as is” and “as available.” I do not make promises that the app will be uninterrupted, secure, accurate, or fit for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of Fren.

To the fullest extent permitted by law, my total liability for any claim related to Fren will be limited to the amount you paid for Fren in the 12 months before the event giving rise to the claim, or 50 EUR if you have not paid anything.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict of law rules. The courts of Lisbon, Portugal will have exclusive jurisdiction over disputes relating to these Terms or your use of Fren, except where applicable consumer law says otherwise.

Changes to These Terms

I may update these Terms from time to time. If I do, I will update the “Effective Date” at the top of this page. By continuing to use Fren after updated Terms take effect, you agree to the revised Terms.
